Retirement & flexible retirement requests
- Can I choose my own Company standard retirment age, e.g. 60, 65, 70?
- I have an employee who is due to retire in a year. What must I do? (the flexible retirement procedure is now required by law)
You must write to the employee between 6 and 12 months from their date of retirement setting out their retirement date and their legal right to request an extension of employment. If they do request an extension they will be entitled to attend a hearing with you to discuss this and an appeal if they are unhappy with the answer. A failure to fully apply this statutory procedure could result in a tribunal award against you of 8 weeks pay and has potential discrimination law implications. You should implement a policy and prodedure in your Company to detail how you will handle 'retirement dismissals'.
