Employer's Guide to Changing Contractual Terms

Employer's Guide to Changing Contractual Terms

This is a guide to the complex area of changing employees' terms and conditions of employment. Attempting to change terms and conditions, without following the correct procedures can be very dangerous - Employment Tribunals, County and High Court claims are all possible. This guide sets out in clear and easy to follow format, what to consider before starting a process, what to do and what not to do.  This guide is only designed to give you a good idea of the process to follow - we do advise that you take advice on the particular circumstances of your case, particularly if the change you are trying to achieve;

a) relates to a TUPE transfer, i.e. employees you have acquired by the virtue of buying a business or taking over a contract for services from another Company; or
b) involves a change towards less favourable terms than those currently enjoyed by employees; or
c) is being objected to by one or more employees.

See the employer's guide to contracts of employment for more general guidance on the importance and interpretation of contractual terms.
